Buffalo Attorney Pleads Guilty to Attempted Grand Larceny

Tax Department charged him with collecting withholding tax from his employees, but not remitting it

The New York State Department of Taxation and Finance announced today that an attorney practicing in Buffalo has pled guilty to attempted grand larceny.

David J. Seeger, 57, of 17 St. Johns St., Buffalo, the principal attorney of his law office, David Seeger PC, located at 69 Delaware Avenue in Buffalo, admitted in Erie County Court before Judge Thomas P. Franczyk that he attempted to steal $21,281 by failing to pay the State Withholding Tax on behalf of his law firm employees for the years 2009 through 2012.

Seeger entered a guilty plea on July 22 to one count of attempted grand larceny in the fourth degree, a misdemeanor, for failing to file the appropriate returns and pay those taxes.

The defendant also pled guilty to one count of criminal tax fraud in the fifth degree, a misdemeanor, for failing to file his 2011 New York State personal income tax return.

As part of his plea he made full restitution to the State for the withholding taxes owed.

The defendant is scheduled to be sentenced on October 14. He could receive up to one year of jail time.

The case was investigated by the Tax Department’s Criminal Investigations Division and is being prosecuted by the Erie County District Attorney’s Office.
