LIEUTENANT GOVERNOR BRIAN BENJAMIN AND FAMILY OF ELIJAH SILVERA MARK THE FULL IMPLEMENTATION OF ELIJAH’S LAW

Elijah’s Law Requires OCFS-Licensed and Registered Child Care Providers to Have an Emergency Anaphylaxis Response Plan and Allows Providers to Have Auto Injectors for Small Children On Site

Three-year-old Elijah Silvera went into anaphylaxis shock and died after being served a grilled cheese sandwich at his child care program in 2017, even though the program had been notified of his food allergy. His, in partnership with then-Senator Brian Benjamin and Assembly Member Al Taylor, developed legislation to prevent such tragedies in the future.

The legislation was signed into law in September of 2019 and is now been fully implemented, requiring all New York State Office of Children and Family Services licensed and registered child care programs to have an anaphylaxis plan. The state is also offering providers free auto injectors and training on how to use them.

Thomas Silvera, Elijah’s father, will speak and will demonstrate how to use an AUVI-Q epinephrine auto injector pen at the event.
