Virtual Public Statement Hearings Set Regarding Con Edison’s Electric and Gas Rates

ALBANY — The New York State Public Service Commission (Commission) will hold virtual public statement hearings on Wednesday, March 29, and Thursday, March 30, 2023, concerning proposed changes in the electric and gas delivery rates and practices of Consolidated Edison Company of New York, Inc. (Con Edison).

On February 16, 2023, trial staff of the Department of Public Service (DPS) filed a joint proposal with the Commission seeking approval to increase Con Edison’s annual electric and gas delivery revenues over three years.  In addition to Con Edison and DPS staff, the joint proposal is signed by the City of New York, New York Energy Consumers Council, Inc., Walmart, Metropolitan Transportation Authority, Consumer Power Advocates, New York Power Authority (as to electric rates only), Natural Resources Defense Council (as to electric rates only), and the New York Geothermal Energy Organization.
 
The joint proposal contains terms that would establish new electric and gas rate plans for Con Edison for three years starting January 1, 2023, with Rate Year 1 (RY1), Rate Year 2 (RY2), and Rate Year 3 (RY3) defined as the 12 months ending on December 31, 2023, December 31, 2024, and December 31, 2025, respectively.  As levelized to moderate rate impacts on customers, the joint proposal’s terms, if approved, would result in an increase in electric delivery revenues of $457.5 million for each rate year, with a cumulative total electric delivery bill revenue increase of 19.8 percent and total electric bill increase of 12.5 percent, and an increase in gas delivery revenues of $187.2 million for each rate year, with a cumulative total gas delivery bill revenue increase of 31.3 percent and a total gas bill increase of 20.2 percent. The actual bill impacts on any specific customer class would vary based upon revenue allocation and rate design.

Under New York State Law, the Commission may adopt, modify, or reject the terms of the joint proposal, in whole or part.  Administrative Law Judges (ALJs) are presiding over the gathering of public comments and all evidence relating to the joint proposal.

Those wishing to comment on any aspect of the joint proposal will have the opportunity to make a statement on the record at the virtual public statement hearings.  Any person wishing to provide a public statement on the record must pre-register to do so by 3:00 p.m. on Monday, March 27, 2023, for the March 29 hearings, and by 3:00 p.m. on Tuesday, March 28, 2023, for the March 30 hearings.
 
To pre-register and provide a statement electronically:  Participants who would like to provide a statement and will log in to a hearing electronically must pre-register by the date and time indicated above by visiting www.webex.com, where they should click “Join” at the top right-hand corner of the screen, enter the appropriate event number listed above, and provide all requested information.
 
When logging in to participate in a hearing at the appropriate date and time, participants should visit www.webex.com, click “Join” at the top right-hand corner of the screen, and input the appropriate event number listed above. Participants will be asked to “select audio system.” It is recommended that participants opt to have the system “call me” or “call using computer.” The “call me” option will require participants to enter their phone numbers.
 
To pre-register and provide a statement by phone:  Any participant who is not able to log in to a hearing electronically may participate by phone.  Call-in participants wishing to make a statement at a hearing must register to do so by the date and time indicated above by calling 1-800-342-3330, following the prompts to the appropriate hearing and then providing the following information: first name and last name, address, and phone number.
 
On the appropriate day and time of the hearing, dial (518) 549-0500 and enter the relevant access code, listed above, to join the hearing.
 
All participants will be muted upon entry into the hearing.  The public statement hearings will be held open until everyone who has registered to speak has been heard or other reasonable arrangements to submit comments into the record have been made.  Reasonable time limits may be set for each speaker as necessary to afford all registered speakers an opportunity to be heard.  It is recommended that lengthy comments be submitted in writing and summarized for oral presentation. A verbatim transcript of the public statement hearings will be made for inclusion in the record of these proceedings.
 
To listen to the hearings:  Any person who would like to listen to the hearings without making a statement may access the hearings without pre-registering.  The hearings will be livestreamed on the internet and available for viewing on the Department’s YouTube channel on the dates and times listed above.  To access the YouTube channel, visit the Department’s website, www.dps.ny.gov, and click on the YouTube icon at the bottom of the homepage.  In addition, any person without internet access may listen to the hearings by phone by calling (518) 549-0500 and entering the applicable access code.
 
Persons with disabilities requiring special accommodations should call the Department’s Human Resources Management Office at 518-474-2520 as soon as possible. TDD users may request a sign language interpreter by placing a call through the New York Relay Service at 711. Individuals with difficulty understanding or reading English are encouraged to call the Department at 1-800-342-3377 for free language assistance services regarding this notice.
 
Other Ways to Comment:  For those who cannot attend or prefer not to speak at the public statement hearings, there are several other ways to provide your comments to the Commission. Comments should refer to “Case 22-E-0064 – Con Edison Electric” or “Case 22-G-0065 – Con Edison Gas.” Although comments will be accepted throughout the pendency of these proceedings, they are requested by April 14, 2023.
 
Internet or Mail:  Go to www.dps.ny.gov, click on “File Search” (located under the heading “Commission Files”), enter “22-E-0064” or “22-E-0065” in the “Search by Case Number” field, and then click on the “Post Comments” box located at the top of the page.
 
Alternatively, comments may be mailed to the Hon. Michelle L. Phillips, Secretary, Public Service Commission, Three Empire State Plaza, Albany, New York 12223-1350. All written comments will become part of the record considered by the Commission and may be accessed on the Department of Public Service website by searching the case number, as described above, and clicking on the “Public Comments” tab.
