Forensic Accountant Sentenced for Failing to Pay $114,000 in Income Taxes

Long Island resident didn't file his tax returns several years in a row

The New York State Department of Taxation and Finance Commissioner Thomas H. Mattox today announced the sentencing of a Long Island man for failing to pay $114,295 in personal income taxes for the years 2004 through 2008.

Richard Edelson, 44, of 22 Westminster Court South, Nesconset, NY, appeared before the Hon. Fernando Camacho in New York State Supreme Court and was sentenced to three years probation.  During the probation period he must pay the State a total of $203,375 in restitution.

Edelson, who identified himself as a forensic accountant, was convicted of Failure to File a Return or Report, a misdemeanor.

The case was investigated by the Tax Department’s Criminal Investigations Division and prosecuted by the Office of the Suffolk County District Attorney.

“I commend District Attorney Thomas J. Spota and his team for their continued focus on enforcing our state’s tax laws and pursuing the prosecution of this case,” said Commissioner Mattox.  “The defendant worked in the financial industry, and certainly knew failing to pay income taxes would eventually catch up with him.”

In New York State, 96% of taxes are paid by businesses and individuals who voluntarily meet their tax responsibilities. The remaining 4% is collected through the Tax Department's audit, collections and criminal investigations programs. Through its enforcement programs, the Department ensures fair tax administration for all New Yorkers.
