The New York State Department of Taxation and Finance today announced the arraignment of a Rochester man accused of filing multiple state tax returns seeking tax credits under assumed identities.

Norbert P. Kostyj, 65, of 5122 Saint Paul Boulevard, was charged with grand larceny, a felony. From 2010 to 2014, he allegedly filed multiple returns under different names and with different home addresses, claiming a total of $3,252 in improper refunds.

“Filing false tax returns to receive undeserved refunds is a serious crime with significant penalties,” said Commissioner Jerry Boone. “We will continue to work with Monroe County District Attorney Sandra Doorley—and all levels of law enforcement—to root out tax fraud and hold accountable anyone who willfully violates tax laws.”

If convicted, Kostyj faces up to seven years in prison and a fine of more than $6,000.

Kostyj was arraigned in Irondequoit Town Court. The Monroe County District Attorney’s office will prosecute the case. A court date for the defendant’s next appearance has not been set.

A criminal complaint is an accusation and the defendant is presumed innocent until proven guilty.
