Virtual Public Statement Hearing Set Regarding Alle-Catt Wind

ALBANY — The New York State Public Service Commission (Commission) will hold a virtual public statement hearing on Tuesday, May 21, 2024, concerning a petition filed on June 14, 2023, by Alle-Catt Wind Energy, LLC (Alle-Catt) pursuant to Section 68 of the Public Service Law (PSL) for a Certificate of Public Convenience and Necessity (CPCN) to establish lightened regulation as an electric corporation, and to approve construction financing associated with a 340-megawatt wind farm in Allegany, Cattaraugus, and Wyoming counties.

In related proceedings, on June 3, 2020, the New York State Board on Electric Generation Siting and the Environment (Siting Board) granted Alle-Catt a Certificate of Environmental Compatibility and Public Need (CECPN) to construct and operate the wind farm pursuant to Article 10 of the PSL. On February 10, 2021, Alle-Catt filed an application with the Commission for a CECPN pursuant to Article VII of the PSL to construct a 10-mile transmission line interconnecting the project with a National Grid 345 kV transmission line at the Homer City-Stolle Road switchyard in the Town of Yorkshire, Cattaraugus County. The transmission facility will connect the project to the State’s electric grid. On March 3, 2022, the Commission found the CECPN Article VII application for the transmission facility to be complete and it is currently pending before the Commission (Case 21-T-0059).
 
The scope of the Commission’s review of the CPCN petition that is the subject of this hearing will not duplicate the issues that were previously considered and decided by the Siting Board in its 2020 order or the issues that are currently pending before the Commission for the transmission facility.

For those who cannot attend or prefer not to speak at the public statement hearing, there are several other ways to provide your comments. All comments should refer to Case “23-E-0391” and must be submitted no later than June 5, 2024.

Internet or Mail:  Go to www.dps.ny.gov, click on “File Search” located under the heading “Commission Files”, enter “23-E-0391” in the box labeled “Search by Case Number”, and then click on “Post Comments” at the top of the page.

Alternatively, comments may be mailed to the Hon. Michelle L. Phillips, Secretary, Public Service Commission, Three Empire State Plaza, Albany, New York, 12223-1350. All written comments will become part of the record considered by the Commission and may be accessed on the Department of Public Service website by searching the case number, as described above, and clicking on the “Public Comments” tab.

Toll-Free Opinion Line: Individuals may submit comments by calling the Commission’s Opinion Line at 1-800-335-2120. This number is set up to take comments about pending cases from in-State callers 24-hours a day. These comments are not transcribed verbatim, but a summary is provided to the Commission.

PLEASE TAKE FURTHER NOTICE that a virtual procedural conference will be held immediately following the public statement hearing, as part of the same teleconference.

The principal purposes of the procedural conference are to identify any potential parties and provide interested persons an opportunity to present and explain any proposals regarding the procedures they believe should be followed in this case by the ALJs and Commission including, but not limited to, whether any issues of fact presented by the petition or public comments warrant an evidentiary hearing. Other procedural issues also may be addressed.
