Westchester County Resident Arrested for Failing to File State Income Taxes

Tax Department says he owes more than $130,000 for years 2004 through 2010

The New York State Department of Taxation and Finance today announced the arrest of a Westchester County resident for repeatedly failing to file State income tax returns.

Jay Digiulio, 53, of 57 Claremont Ave., Rye, NY, appeared before the Hon. Joseph Latwin in Rye City Court and was charged with three felony counts of Criminal Tax Fraud.  Judge Latwin set January 21, 2014 for Digiulio’s next court appearance and released him on his own recognizance.

According to the charges, Digiulio repeatedly failed to file personal State income tax returns for the years 2004 through 2010, failing to pay the State at least $131,891 in back taxes.

The case was investigated by the Tax Department’s Criminal Investigations Division and will be prosecuted by the Westchester District Attorney’s Office.

In New York State, 96% of taxes are paid by businesses and individuals who voluntarily meet their tax responsibilities. The remaining 4% is collected through the Tax Department's audit, collections and criminal investigations programs. Through its enforcement programs, the Department ensures fair tax administration for all New Yorkers.
